Warranty
The Somerville Electric Vehicle Company (“SomEV”) warrants to the original purchaser of the SomEV product that it is free from defect in materials and/or workmanship for a period of 12 months from the date of purchase or 500 miles, whichever occurs first. This limited warranty does not cover normal wear and tear or any damage, failure or loss caused by improper maintenance, storage or use of the SomEV electric scooter, electric bicycle, electric moped, or electric cargo bicycle. This limited warranty will be void if the product is ever used in a manner other than for transportation or recreation, modified in any way, or is rented out for use by other person(s). The costs/inconvenience caused by the loss of use of the product is not covered whilst the warranty procedure takes place. Furthermore, stolen SomEV vehicles are not covered under warranty.
During the limited warranty period, if this product appears to contain a defect covered by this limited warranty, email info@som-ev.com for further instructions on filing a warranty claim. You will be required to have registered your purchase using the instructions provided upon receipt of your SomEV product, and provide a dated proof-of-purchase receipt with any product returned for warranty repair.
Products returned to SomEV for warranty repair, which upon receipt by SomEV are confirmed to be defective and covered by this limited warranty, will be repaired or replaced (at SomEV’s sole option) at no cost to you and returned pre-paid to customers located within the Continental United States.
ALL IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE ONE-YEAR LIMITED WARRANTY PERIOD SET FORTH ABOVE, AND NO IMPLIED WARRANTIES WILL EXIST OR APPLY AFTER SUCH PERIOD. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. THIS LIMITED WARRANTY DOES NOT COVER NON-DEFECT DAMAGE, DAMAGE DUE TO NORMAL WEAR AND TEAR, DAMAGE CAUSED BY IMPROPER OPERATION, MAINTENANCE OR STORAGE OF THE PRODUCT (INCLUDING, BUT NOT LIMITED TO ABUSE, MISUSE, FAILURE TO PROVIDE REASONABLE AND NECESSARY MAINTENANCE, UNAUTHORIZED REPAIRS OR ANY ALTERATIONS TO THIS PRODUCT). IN NO EVENT SHALL SomEV’s LIABILITY FOR BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE OR STRICT LIABILITY EXCEED THE COST OF THE PRODUCT COVERED HEREBY. NO PERSON IS AUTHORIZED TO ASSUME FOR SomEV ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF THIS PRODUCT.
Some states do not allow the exclusion or limitation of consequential, incidental or special damages, so the above limitation or exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
Accessories sold on www.som-ev.com are not covered under warranty (except in cases of shipping damages).
Pre-Orders
When pre-ordering a product from our website your card will be charged in the full amount of the total purchase price immediately.
During pre-orders SomEV provides an estimate of when products may ship. We reserve the right to change the estimated shipping date at any time without notice.
A pre-order may be cancelled at any time before the vehicle has shipped for a full refund.
Performance Disclaimer
The vehicles listed range and top speed are estimates of expected performance and are not guaranteed. We pride ourselves in rigorous testing and ensuring that we meet performance expectations however, performance may vary with due to several conditions such as terrain, rider weight, weather conditions, battery charge level, age of battery, tire pressure, etc.
Credit Card Chargebacks
If a credit card chargeback is requested on an order, and the customer is still in possession of the product or products within the order, the chargeback, refund, or credit will not be processed until the product has been returned to us. If we determine the customer will retain the product, the warranty may be suspended indefinitely based on the sole discretion of SomEV. In most cases, once the chargeback is resolved the warranty will resume from the original date of shipping as outlined in the warranty without any extension for the time the warranty was suspended.
Liability Disclaimer
Under no circumstances is SomEV liable for any consequential, special, or incidental damages arising directly or indirectly in connection with use, or inability to use this product. This includes, but is not limited to, damage to personal property, personal injury, or death.
